1. Acceptance of Terms

By accessing or using this website (gulfpestsolutions.com) or by scheduling services with Gulf of America Pest Solutions LLC (“Company,” “we,” “our,” or “us”), you agree to be bound by these Terms and Conditions. If you do not agree, please do not use this website or our services.

2. Services Provided

Gulf of America Pest Solutions LLC provides professional pest control services in accordance with:

  • Alabama Department of Agriculture & Industries regulations

  • Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA)

  • EPA label requirements

  • All applicable state and federal laws

Services may include, but are not limited to:

  • General household pest control

  • Termite inspections and treatments

  • Trelona® bait station installation and monitoring

  • Mosquito reduction programs

  • Rodent control

  • Bed bug inspections and treatments

All services are subject to inspection, property conditions, and eligibility requirements.

3. Estimates & Inspections

All pricing provided online or verbally is an estimate unless otherwise stated in writing.

Certain services (including termite treatments, bed bug treatments, and structural pest issues) require an on-site inspection before final pricing can be determined.

The Company reserves the right to adjust pricing based on:

  • Size of structure

  • Severity of infestation

  • Accessibility

  • Environmental conditions

  • Required materials and labor

4. Scheduling & Access to Property

Customers agree to:

  • Provide safe and unobstructed access to treatment areas

  • Secure pets prior to service

  • Disclose known hazards (including electrical issues, structural damage, or aggressive animals)

Failure to provide proper access may result in rescheduling fees.

5. Payment Terms

We accept payments through:

  • Wix Payments

  • Square

  • Integrated CRM billing via GorillaDesk

Payment is due at the time of service unless otherwise agreed in writing.

For recurring services:

  • Payment methods may be stored securely through our payment processor.

  • Customer authorizes recurring billing for selected service plans.

Late payments may result in:

  • Service suspension

  • Late fees

  • Collections action

6. Recurring Service Agreements

Recurring pest control programs (monthly, bi-monthly, quarterly, or mosquito seasonal programs) automatically renew unless canceled.

Cancellation requires written notice prior to the next scheduled service date.

Early termination fees may apply if stated in a signed service agreement.

7. Satisfaction & Retreatment Policy

We stand behind our work.

If covered pests return between scheduled visits, we will provide retreatment at no additional charge, subject to:

  • Customer compliance with service recommendations

  • Property conditions not materially changed

  • Exclusion of pests not covered under the selected plan

Certain pests (including termites, bed bugs, wildlife, or severe infestations) may require separate service agreements.

8. Limitations of Liability

To the fullest extent permitted under Alabama law:

  • The Company is not liable for pre-existing structural damage.

  • The Company is not responsible for indirect, incidental, or consequential damages.

  • Total liability shall not exceed the amount paid for the specific service rendered.

Pest control reduces and manages pest populations but does not guarantee permanent eradication due to environmental and structural factors beyond our control.

9. Termite & Wood Destroying Organism Services

Termite services are performed in accordance with:

  • Alabama Department of Agriculture & Industries regulations

  • Product label requirements (including Trelona® or other approved termiticides)

Termite warranties, if offered, are governed strictly by the written termite agreement provided at time of service.

Website information does not constitute a termite bond or guarantee unless expressly stated in a signed contract.

10. Website Use

Users agree not to:

  • Attempt unauthorized access to the website

  • Interfere with site functionality

  • Use the website for fraudulent scheduling or payment disputes

We reserve the right to restrict access to anyone violating these terms.

11. Intellectual Property

All website content including:

  • Logos

  • Branding

  • Text

  • Graphics

  • Service descriptions

are property of Gulf of America Pest Solutions LLC and may not be copied or reproduced without written permission.

12. Compliance With Laws

All pesticide applications are performed:

  • By licensed technicians

  • Under supervision of a Certified Operator

  • In compliance with state and federal law

We strictly follow all EPA-approved label directions. The label is the law.

13. Privacy

Use of this website and payment processing is also governed by our Privacy Policy.

We utilize secure third-party payment processors (Wix Payments, Square). We do not store full credit card information on our servers.

14. Changes to Terms

We reserve the right to update these Terms and Conditions at any time. Updated versions will be posted on this page with a revised effective date.

15. Governing Law

These Terms and Conditions shall be governed by the laws of the State of Alabama.

Any disputes shall be resolved in a court of competent jurisdiction in Alabama.

18. Strong Limitation of Liability

To the maximum extent permitted by Alabama law:

  1. The Company shall not be liable for:

    • Pre-existing damage

    • Hidden structural defects

    • Water intrusion

    • Mold

    • Electrical issues

    • Wildlife entry points

    • Conditions beyond our control

  2. Pest control services are intended to reduce and manage pest populations, not guarantee complete or permanent eradication.

  3. The Company is not responsible for:

    • Allergic reactions

    • Sensitivities

    • Misuse of treated areas by occupants

    • Failure of Customer to follow post-treatment instructions

  4. Under no circumstances shall the Company be liable for:

    • Indirect damages

    • Incidental damages

    • Consequential damages

    • Loss of business income

    • Diminished property value claims

  5. Total liability for any claim shall not exceed the total amount paid by the Customer for the specific service at issue.

19. Alabama & Federal Pesticide Notice

All pesticide applications are performed in strict compliance with:

  • Alabama Department of Agriculture & Industries regulations

  • Alabama Administrative Code (Chapter 80-10-9 and related rules)

  • Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA)

  • EPA-approved product labeling

The pesticide label is the law.

Pesticides will be applied only:

  • By properly licensed technicians

  • Under the supervision of a Certified Operator

  • In accordance with label instructions

Customers acknowledge:

  • They will be informed of products used upon request.

  • They may request Safety Data Sheets (SDS) for products applied.

  • They must follow all post-treatment instructions provided.

The Company reserves the right to refuse service if conditions violate label requirements or create safety risks.

20. Environmental & Safety Acknowledgment

Customer agrees to:

  • Keep children and pets away from treated areas as directed.

  • Follow re-entry times provided.

  • Notify the Company of any known chemical sensitivities prior to service.

Failure to comply with safety instructions releases the Company from liability related to improper re-entry or exposure.

21. Severability

If any portion of these Terms is deemed invalid under Alabama law, the remaining provisions shall remain enforceable.

22. Governing Law & Venue

These Terms shall be governed exclusively by the laws of the State of Alabama.

Any permitted court proceedings (if arbitration is deemed unenforceable) shall be filed in the State of Alabama.
